Terms and Conditions

The passenger understands and agrees entirely to the sales conditions of Bariloche Gay Travel which are listed below:

1) RESERVATIONS
Reservations will be completed by means of a down payment equivalent to 30% of the total costs of the solicited services. BALANCE: The remaining balance has to be remitted in full up to 30days after the booking of our services. If this is not accomplished, the company has the right to cancel the reservation without any further notice and the client has no rights to any refund whatsoever. 
2) EXCURSIONS, TOURS OR EVENTS WHICH REQUIRE A MINIMUM NUMBER OF PARTICIPANTS
The company can cancel any excursion, special event, party, tour, etc., up to 5 days before it’s implementation, if the minimum number of participants is not achieved. In the case of cancellation because of not having reached the minimum number of participants, 100% of the client's money already received, will be refunded. 
In these cases the contracting party, be it an agency or the passenger himself, cannot claim more than the amount they would have paid for the reservation from BarilocheGayTravel.
In the case of the eventual cancellation of excursions, tours or events for not having reached the minimum amount of participants needed, it doesn't imply the obligation of any sort of refund to the passenger or the contracting agency.
3) LIMITATION OF LIABILITY
The company declares explicitly that it acts as an intermediary in reserving or contracting the different services linked or included in the respective tour or service reserved: hotels, restaurants, means of transportation, or other providers. The company declines the full responsibility for any deficiency in the mentioned services, as well as for any harm or damage that the passenger could suffer; this is the full responsibility of the service provider. Bariloche Gay Travel does not take any responsibility for changes in schedules, adjournments and/or cancellations, equipment problems, etc. of the transportation company; this is the responsibility of the service provider.
The offered services and tours do not include any kind of medical or life insurance. The majority of the services, events, tours, excursions, etc., take place in areas far away from the center of town, where the medical services and any assistance of that nature, could be far away from the place where the tourist finds himself at that specific moment. 
The company Bariloche Gay Travel will not accept any responsibility regarding eventual accidents and/or damage, death, harm, illnesses,injury, physical or psychological damage, personal harm or any other kind of loss that could occur as a consequence of an action or oversight of any of the suppliers, or for any other eventuality over which we have no control.
It is the responsibility of every passenger to make arrangements for their own medical and/or life insurance before the trip. Bariloche Gay Travel will not be responsible for any delays or possible extra costs as a consequence of illnesses, climatic conditions, wars, terrorism, political events, natural disasters, technical problems or any other circumstance that is beyond our control.
4) ACTS OF SUPERIOR FORCES AND CLIMATIC CONDITIONS
With the exception of proved acts of nature, no refund whatsoever will be made for any tourist service not carried out or canceled within a reasonable time limit. All of the activities and services can be changed at short notice, depending on the acts of nature  and climatic conditions prevailing at that very moment, which guarantee the optimum execution of the activity and the security of the passenger.
Hence the contingencies such as modifications in the schedule on behalf of the service supplier like, strikes, technical incidents, climatic incidents, natural disasters and their consequences are not the responsibility of Bariloche Gay Travel. Nevertheless, we will take all possible measures to act on behalf of our customers if any of the above listed contingencies should occur.
Bariloche Gay Travel has the rights to offer an alternative activity to the passengers if the climatic and/or security conditions are not deemed to be appropriate.
 
5) PRIVACY POLICY
With any consultation that the user/our client makes via Internet, our client has to accept that all information given to us through this manner (email), this information, granting the security conditions given in this day and age by using the internet, can be used or seen by a third party. However, our company tries by all possible means to protect our customer’s private details. Bariloche Gay Travel is not responsible for the broadcasting or publication of our passengers private details, that have been obtained by sources unknown to our company, also we will not be responsible for any eventual damages that may result.
6) ALTERATIONS AND CHANGES
6.1) The company has the right, to totally or partially alter the daily organization and/or services that make up the tour, before or during the tour.
6.2) If not advised to the contrary, the chosen hotels can be replaced by others in the same or in a higher category within the same town without any charge whatsoever to the passenger. Apart from these variations, the passenger doesn't have the right to any other compensation.
6.3) Our company can cancel any tour if one of the circumstances foreseen in the Art. 24 of the decree Nr. 2182/72 should occur.
6.4) If for operative motives or for acts of nature, the company should have to suspend and/or change the continuation of the services already started, the passenger has the right to a refund equivalent of the services not yet used. Refunds: The claims have to be presented within 15 days after the finalization of the holiday. After this period of time, no refunds will be given.
7) THE PRICES DON'T INCLUDE
7.1) Extras, beverages, laundry service, communication services, shipping taxes, VAT, visas, and other actual and/or future taxes, nor any other service not listed on the voucher provided by the travel agent.
7.2) Meals and/or additional costs caused by cancellations, arrival or departure delays due to the means of transportation or for unforeseen reasons, are not the responsibility of our company.
7.3) Meals and beverages en route, except those explicitly mentioned to be included in the programs.
8) LIMITATIONS UPON THE RIGHT OF CONTINUED OCCUPANCY
Our company has the right to make the passenger abandon the tour at any point if the passenger's behavior, course of action, or health condition bothers the other passengers or cause the tour to fall short of complete execution.
9) DOCUMENTATION
The passengers must fulfill the necessary entry requirements according to the prevailing law. The agency has to inform, with enough advance notice, about the requirements requested by customs and immigration authorities for the tour destinations, it is however the full responsibility of the passenger to acquire the personal documentation necessary according to the above mentioned authorities. Bariloche Gay Travel will not be responsible for any missing or incomplete personal documents like, visas, etc. that the customs authorities solicit. Also we will not be responsible for any losses and/or damage that this situation could bring. In the case that the passenger is denied entry to a country, or is not allowed to travel, he will lose all the contracted services without the right to make any claim whatsoever; equally if the authorities of any country deny the entry to the passenger.
10) CANCELLATIONS OR RESCHEDULING MADE BY THE PASSENGER
10.1) In the case of cancellations of services contracted on a firm basis by the agency, the refund depends on the conditions under which the services were contracted by, from the respective company. In any case of repayment, the agency can retain the equivalent to the incurred expenses plus a 10% commission fee for services contracted with a third party.
10.2) Once the trip/holiday has commenced, the rescheduling, postponement or interruption of the services by the passenger for personal or any other kind of reasons, does not give the passenger the right for refunds or complaints.
10.3) If the booked services include any kind of transport, when cancellations or reschedules are made, the tour will be rescheduled depending on availability from the transport company.
10.4) Cancellations and rescheduling will be adjusted to the following norms:
 - Cancellations up to 30 days before the date are at no charge.
 - Cancellations between 15 - 30 days before the date: 50% of the total will be charged as a cancellation fee. This outstanding balance can be used as a credit for other reservations in the same season.
 - Cancellations between 15 - 7 days before the date: 75% of the total will be charged as a cancellation fee. This outstanding balance can be used as a credit for other reservations in the same season.
 - Cancellations within 7 days before the date: 100% of the total will be charged as a cancellation fee. This amount cannot be used for future reservations.
- Once the booking is made and confirmed, US$20 will be charged for any rescheduling.
